The issue, of course, was opioids. The verdict was due later in the day. Introduced by the media was even the historical data of how this leveraging of public nuisance had first been used by state attorneys general against BigTobacco.

Purdue Pharma opted to settle for $270 million with Oklahoma about alleged illegal marketing of opioids. It could have chosen to go to trial in two months - or to file for bankruptcy. Here are details from Bloomberg. This particular settlement sends the message to plaintiffs and their lawyers that this could be what they should be aiming for. Trials are wild cards. And, in a bankruptcy they could wind up with relative peanuts.

Purdue Pharma has done that in Oklahoma for $270 million in the opioid lawsuit, two months before the trial. So far, Bayer has lost two trials in California, one is state court and one in federal, associated with Roundup. Another trial is underway in Oakland. It will probably appeal the approximately $80 million verdict in the federal one - the case of Edwin Hardeman.    One strategy Bayer can pursue, reports Bloomberg , is to continue to go the litigation route.
