This morning on broadcast news the media focus was on how the Oklahoma attorney general Mike Hunter used the concept of public nuisance to bring Janssen Pharma (whose parent if Johnson & Johnson) into court. As many know, public nuisance litigation succeeded in Santa Clara, California against former lead paint manufacturers/marketers. Now along with the CA victory for abatement of lead paint, there is the OK one for abatement of the damage done by opioids.

Maybe the outbreak of other lead paint class action public nuisance lawsuits might not do a number on the stock. Beginning tomorrow, Johnson & Johnson will face off in court with the Oklahoma Attorney General Mike Hunter. Those AGs, dating back to Sheldon Whitehouse in the Rhode Island lead paint class action, who configure public nuisance lawsuits essentially have been hailed heroes. Most recently it was used successfully in a bench trial against former lead paint companies such as Sherwin-Williams in Santa Clara, California.

In a court in Oklahoma, the prosecution is arguing that Johnson & Johnson created a public nuisance. Previously, public nuisance lawsuits have targeted industries ranging from tobacco to lead paint. That is what state attorney general Mike Hunter contends about its marketing practices for opioid type pharmaceuticals. Here is more on that. Regarding the latter, Sherwin-Williams, represented by Jones Day, lost a big one on that in a bench trial in California.
