Tomorrow, the stock market is likely to record this significant legal setback for the gig-economy business model. That law, which went into effect January 1, 2020, mandates that gig workers, with some exceptions, are reclassified as employees. Companies using the gig-worker model have invested plenty of funding to put the issue on the ballot. MarketWatch reports that San Francisco Superior Court Judge Ethan Schulman ordered Uber and Lyft to comply with California AB-5.

This represents a victory for gig economy workers which could spread from New York to other locations in the U.S. That's even though he did gig driving for Uber. That decision can open the door for loosening of rules about eligibility for unemployment compensation for gig workers.  Bloomberg Law reports that drivers for Uber and Lyft in New York had sued in May to receive unemployment compensation payment. As yet, there had been no payment. That will change.

However, ghosting has also become more common in the gig economy. As part of the application for a 20-hour content gig for retirement planning the prospective employer informed him that the good news was that he had made the first cut. So has the gig economy one. Liberal media outlets have gleefully covered an emerging stick-it-to-employers phenomenon. That's  ghosting.    The employer arranges an interview or even sets a start-to-work date.

Experts on Measuring Gig Economy Admit Flawed Studies

Twice, Alan Kruger and Lawrence Katz had conducted surveys of supposed gig-economy workers. In a study last summer, the Department of Labor studied the gig economy and didn't find it had significantly altered traditional ways of earning a living. That is, they really weren't gig workers per se, at least not as contingent jobs were being measured. In addition, the gig work being done was largely in one category: driving for Uber.

That opens the door for other drivers to argue that they were or are "employees," not gig workers. The highest appeals court in France - Cour de Cassation - handed Uber a major defeat. As The Wall Street Journal reports, this has been the first court ruling around the world in which a driver has been classified as an employee. This particular ruling cannot be appealed. That's one reason why this court case is so significant. Uber has similar litigation going on in the U.S.
