Don't distract: Contract!

Speak Schmeak

In my post, Speaking from a script doesn't have to sound scripted , I neglected to mention a big red flag that you're sounding stilted and stiff: Missing contractions. As writing is a more formal way to express ourselves, we tend to write without contractions. That's not to say that you can't mix and match contractions with the written-out version of expressions. If you're writing a speech, go through it sentence by sentence and see where you've left out contractions.

Downside of Decline of COVID-19 Cases: Layoffs for Contract-Tracers

Jane Genova: Speechwriter - Ghostwriter

The good news in Massachusetts is that new cases of COVID-19 are down. So are the deaths. But the bad news is that, after three months, those hired as coronavirus contact-tracers are being laid off. Boston Magazine reports that already about 200 have volunteered to be laid off. Other workers are expected to be terminated.    MA was the first state to launch a formal contact-tracing program. Maybe that has been a factor in getting the virus under control.

Upwork - Realities Of Global Contracting

Jane Genova: Speechwriter - Ghostwriter

are competing in their bidding with contract workers in low-wage nations like the Philippines. Upwork is the global digital platform where those needing services of freelancers place help-wanted notices and freelancers bid on the project. In the process, freelancers create a formal pitch letter. Sometimes they also have to respond to other questions from the prospect. One attachment is allowed.

Mediation - The Current Cool in Resolving Contract Disputes

Jane Genova: Speechwriter - Ghostwriter

What is getting traction is, as indicated in Law.com, the recommendation by some lawyers that those with contract disputes choose mediation. There could be a trend for opting for mediation when there is a contract dispute. In so many circles, alternate dispute tool arbitration is taking it on the chin. Third party advocates have been pushing back on their mandated use for employees and consumers of financial products.

Sports Illustrated Cutting 40 Positions, Adding 200 Contract Workers

Jane Genova: Speechwriter - Ghostwriter

What's obvious is that full-time media employees are vulnerable to job cuts when a property changes hands and contract ones land new opportunities. Connect the dots on this one. Recently, The Maven licensed the rights to Sports Illustrated print and digital editions. The Wall Street Journal reports that it will be eliminating 40 positions and then hiring 200 gig workers to cover sports.    However, this trend might be short-lived. In California, AB-5 became law.

Contract Killers - Among America's Anti-Heroes (a nation founded by outliers)

Jane Genova: Speechwriter - Ghostwriter

A subcategory of that is the contract killer. " In "The Godfather," contract killers were a necessary moving part of keeping the family business going. Allegedly he could have been contracted to murder four or more people.    Not that a nation where the vestiges of Puritanism still dominate condones contract killing. Contract killers can make a good buck. America had been founded by a bunch of misfits.

Arianna Huffington Contracted Until 2019 - Huge Implications

Jane Genova: Speechwriter - Ghostwriter

"The president and editor-in-chief of the Web publication [HuffPost] announced in an internal memo on Thursday that she had just signed a new four-year contract to remain at the site she founded in 2005." That could mean a continuing pruning of functions and actual employees and contract workers. When I was a contract blogger at AOL, before HuffPost took over, what was given top placement on the site was content that had a video attached.

Writers as Contract Workers

Jane Genova: Speechwriter - Ghostwriter

We writers are no newbies at being contract workers.   In an oddball case, nine exotic dancers filed a lawsuit against their contract employer Penthouse Executive Club.    That means that other contract workers at that employer can piggyback on that legal complaint.  The defendant contends that as contract employees the plaintiffs are not covered by the protections of federal and state labor laws.

Contract Drivers v. Uber - It's back to the drawing board

Jane Genova: Speechwriter - Ghostwriter

Obviously, the next step for this lawsuit is being watched by the many companies which also use contract workers.   The current Uber contract drivers or if they became employees wouldn't be needed any more. No surprise, U.S. District Judge Edward Chen rejected the proposed $100 million settlement in class action "O'Connor v. Uber Technologies" as well as a similar class action suit in Massachusetts.

Job-Hiring Process, Even For Contract Work, Takes More Time

Jane Genova: Speechwriter - Ghostwriter

The extended time the job-hiring process takes also applies to contract or on-demand-economy jobs.   For a contract job in sales I had to complete online multiple forms about background details. "Stephen Davis, an economist at the University of Chicago, found that as of April the average job sat vacant for 27.3 days before being filled, nearly double the 15.3 days it took to fill a job in mid-2009." For Whom the Bell Tolls: Uber Investors, Full-Time Employees, Contract Workers

Jane Genova: Speechwriter - Ghostwriter

Those include, of course, Uber contract drivers.  Growth in market share/revenue no longer cuts it with investors. Not without any sign of profits. Amazon did pull that off. But that was then. The world of investing has changed. Uber is a public company and it's come under the scrutiny of traditional kinds of shareholders. That wild west of hopes about making a killing investing in digital startups has been tamed. And it isn't only in traditional public markets.

Passed Over: Happens to contract employees too

Jane Genova: Speechwriter - Ghostwriter

But since more and more of us are contract workers, there has got to be additional coverage of when we get passed over for jobs and plum assignments. The worst part of being "passed over" for a professional opportunity is the surge of self-doubt.    Sure, we miss out on money, prestige, and the shot at the next step up the ladder.

Jane Genova: Speechwriter - Ghostwriter

It was believed that class action gender discrimination lawsuit - "Dawn Knepper et al. Ogletree" - would be another blockbuster. Again, here was a female law partner (nonequity, though) and others taking on a BigLaw firm and being represented by Superlawyer in that category David Sanford. But that might not be. As Law.com reports the lawsuit might disappear and reconfigure as a bit of arbitration. Knepper hadn't opted out of arbitration.

Romance at Work - Sure, Love Contracts Exist, But Human Heart Is Fragile Entity

Jane Genova: Speechwriter - Ghostwriter

As Erin Mulvaney reports in Corporate Counsel (reprinted in Law.com), more employers are adopting what's called the "love contract."  Romances in the office always had taken place. But, with increased time spent in the workplace, they are even more likely to develop.    And, in this era of heightened consciousness about sexual harassment, those relationships have become of significant legal concern for employers.

Public Speaking: Contract Marketing

Great Public Speaking

Contract marketing is one way to do it. The idea is to put a mention of other products or services in your contract / agreement after you have landed the speaking engagement. You might say, "Tom, why don't you just discuss additional product sales up front with the meeting planner and put the deal right in your contract?" The reason is that the meeting planner doesn't always know how much budget that is available for this until all the top priorities are under contract.

The financial institution's chief executive officer John Cryan is candid about the possibility that robots could take over half of the 97,000 jobs.

Only 88,000 Jobs Created in March: Think contract work

Jane Genova: Speechwriter - Ghostwriter

With only 88,000 jobs created in March, it's time more professionals begin thinking about contract work as a career path.    Right now I have a job, an amazing accomplishment at age 67, after a quarter of a century of working contract.    Even if they continue to land themselves full time permanent jobs with benefits the mindset has to be that of the free agent, that is someone who lives by hustle.

Era of Resentment and Push-back: There are provisions in contracts for all that

Jane Genova: Speechwriter - Ghostwriter

A sign of our rage-filled, mean-spirited times, I just signed a contract with a new client which has this provision: "Both parties agree that for two years from the signing of this agreement they will not make disparaging remarks about each other to third parties." Now there is no social contract between those writing the check and those doing the work.

Bypassing Those Arbitration Clauses in Employment Contracts

Jane Genova: Speechwriter - Ghostwriter

A way around the employment agreements requiring individual arbitration and prohibiting collective legal action (class action lawsuits) has been the California Private Attorneys General Act (PAGA). The state, rather than any individual, is the entity filing the complaint. Here is a comprehensive discussion of PAGA by Bloomberg columnist Josh Eidelson. And that Act is at the heart of the lawsuit filed by former Jones Day partner Wendy Moore alleging gender discrimination.

That was fun, now it's done: New career path of contract worker

Jane Genova: Speechwriter - Ghostwriter

In the 21st century, one of the project economy, contract-worker careers are becoming closer and closer to that of a migrant worker.    Since there are a growing number of contract workers, a good pitch, with terms and conditions favorable to the buyer, doesn't nail down the assignment so often.  In the 20th century, the career of a free agent was mostly stable.
